  • SAVANNAH, Ga. (AP) — A Georgia teenager shot a 13-month-old baby in the face while trying to rob the child’s mother, according to an indictment returned Wednesday that also charged the suspect with shooting another person in an unrelated robbery attempt earlier this month.

The indictment by a Glynn County grand jury charges 17-year-old De’Marquise Elkins on 11 counts, including malice murder, in the slaying last Thursday of young Antonio Santiago a few blocks from his home in coastal Brunswick.

Another suspect, 15-year-old Dominique Lang, was indicted on seven counts including felony murder. But the indictment specifies that authorities believe it was Elkins who shot the child and wounded his mother with a .22-caliber revolver as the boys tried to steal money from her.

District Attorney Jackie Johnson of the Brunswick Judicial Circuit said in a statement Thursday she would not seek the death penalty against either suspect because Georgia law doesn’t allow capital punishment for defendants charged with crimes committed before they were 18. Both teens are charged as adults.

Elkins is now also charged with a second attempted robbery and shooting that happened 10 days before the baby was slain. On March 11, according to the indictment, Elkins tried to rob a person identified as Wilfredo Calix-Flores, pointing a gun at him while demanding his cellphone and wallet. Elkins shot Calix-Flores in the arm with the same caliber revolver used to kill the baby 10 days later, the indictment says. He is charged with attempted robbery and assault with a deadly weapon.

The few details contained in the indictment seem to back up the story the slain baby’s mother, Sherry West, has repeated to numerous reporters: She was pushing her baby in a stroller as she walked home from the post office when two youths approached asking for money. West says when she refused, the older teen drew a gun and shot her in the leg before shooting her son in the head.

Glynn County Police Chief Matt Doering told reporters Wednesday before the indictment was returned that investigators believe the crime was random — something police hadn’t said previously.

    1. I picked mine up yesterday and it is the most gorgeous Louis Vuitton bag I’ve ever seen. You really have to see it in person to see how beautiful the colors are. My daughter, who doesn’t have the same love for purses that I have, even gasped when my SA brought it. And she’s 19 and she loved it too!!!!!!

    2. This is beyond horrifying. However, everyone knows that if the innocent baby and mother had been black and the teens white, we would be getting this nonstop, 24/7, riots, the Jessie and Al show, Black Panthers putting bounties on white peoples’ heads, etc. Problems are never corrected by ignoring them, and in fact are perpetuated and increased by excusing them.

        • The news media sure is quiet. Other than NBC unethically doctoring a 911 tape to make it appear to be racism, how is this any less a racist shooting than the Trayvon Martin matter? Why does Trayvon get so much shrieking, wailing, candle light vigils and the outrage of the black community and the execution of a 13 month old white baby gets nothing? A middle aged white woman and a white baby were singled out by two predatory black teens because they were white and easy to rob and kill. How is that not racism and the Trayvon matter is? You can bet that had it been my wife and child and I pulled a pistol and killed them both there would be outrage over me shooting these two confused black teens who meant no harm. Their mom and auntie would tell us how they were such good boys and Rev. Al and Jessie would give press conferences. I’d be savaged by the news media, sued, and the Black Panthers would put a bounty on my head.

    3. This is a shame. When I got to old to ask my parents for money, I didn’t rob people; I got a job. They need to spend the rest of their lives locked up.

    4. Am I simple or does this sound like in cold blood? Where is the logic – someone under 18 can kill but should not be killed! Who is to say this is not their first burglary – but just the first time they got caught. I so believe in the death penalty for cases beyond a reasonable doubt. Enough is enough, when does it stop. If you are grown enough to carry and use a gun, you are grown enough to suffer the consequences of your behavior. And the same applies to the trifling adults in his life that feel they should condone his behavior. My child knows, you do the crime – you do the time and do not call me!

    5. This is so sad. First this sick child and his friend are accused of trying to rob a person 10 days prior then last week shoot and kill a BABY!! There is a special place in HELL for that pair of idiots. The DA will not pursue the death penalty because these (2) POS are under 18. Well when they turn 18 get a .10 bullet and let’s call it a day. Tax-payers dollars should not go to keeping these fools around for the next 50 or 60 years. But sometimes justice comes in different forms and these two might find a little jail house justice once they are locked away. Watch out for Bubba!!!!!

    6. I was afraid they would try and charge this boy without something more than an eyewitness ID, because they are so unreliable. Happy that didin’t happen. Sad at the same time that they have reason to charge him. Heaven help us.
