A former district attorney is defending his investigation into a 2004 sexual assault accusation against Bill Cosby in Pennsylvania.

Former Montgomery County District Attorney Bruce L. Castor Jr. says he put his best people on the case a decade ago and investigated it thoroughly.

He was testifying Tuesday morning for defense lawyers who want a judge to dismiss the felony sexual assault case against Cosby. A new prosecutor arrested Cosby on Dec. 30, just before the statute of limitations expired.

The defense says Cosby had a deal with Castor that he wouldn’t be charged and should therefore testify in his accuser’s 2005 lawsuit.

Cosby is accused of drugging and violating former Temple University athletics employee Andrea Constand at his suburban Philadelphia mansion in 2004.

Bill Cosby has arrived at a Pennsylvania courthouse where his lawyers will ask a judge to dismiss the felony sexual assault case against him.

Cosby arrived in a black SUV just before 9 a.m. Tuesday, dressed in a tan suit and tie. Two men held his arms for support as he walked up a ramp to the Montgomery County Courthouse in Norristown, and one carried in Cosby’s cane.

The defense says Cosby had a deal with former Montgomery County District Attorney Bruce Castor that he wouldn’t be charged and should therefore testify in his accuser’s 2005 lawsuit.

The 78-year-old Cosby admitted in the testimony that he gave the woman three pills before engaging in what he calls consensual sex acts at his Philadelphia-area home.

A former prosecutor is expected to be a key witness when lawyers for Bill Cosby ask a Pennsylvania judge to dismiss the only criminal case lodged against him.

The defense says Cosby had a deal with former Montgomery County District Attorney Bruce Castor that he wouldn’t be charged and should therefore testify in his accuser’s 2005 civil lawsuit.

The 78-year-old Cosby admitted in the testimony that he gave the woman three pills before engaging in what he calls consensual sex acts at his Philadelphia-area home.

Cosby’s recently released deposition is part of the new evidence that Montgomery County authorities used to file charges in December.

Castor says he made a “non-prosecution” deal with a now-deceased lawyer for Cosby but never put it in writing. He testifies on Tuesday.
