Basketball superstar Kobe Bean Bryant and his mother Pamela Bryant are embroiled in a court battle in U.S. District Court in Camden, New Jersey over Pamela’s intention to sell personal sports memorabilia of the famed superstar. It is reported that Pamela is selling the items left in her home to assist in the purchase of another home in Nevada. Last week, the Judge granted a Temporary Injunction halting the sale of these items which included NBA Championship Rings, Sweat Suits, a basketball signed by the Lakers team, and other items from his days of playing High School basketball at Lower Merion.

What Does This Mean?

A temporary injunction or temporary restraining order prohibits a party, particularly the defendant in most cases, from taking a specific action or actions while the Court continues to hear the case. In this case, Kobe’s counsel most likely filed a Motion or Order to Show Cause, requiring the defendant, his mother Pamela, to argue to the Court why a temporary order should not be granted halting the sale of the personal items.

The Court seems to have agreed with Kobe’s counsel as Pamela Bryant was temporarily prohibited from selling, destroying or otherwise disposing of the items in question.

How Does This Affect You?

A temporary injunction or temporary restraining order can be granted in many different types of cases. They are granted in family law matters, prohibiting one parent from taking a child from a specific jurisdiction, probate matters, prohibiting an executor from disbursing personal or real property and also in breach of contract matters, prohibiting a person from selling, destroying or disposing of particular property. If you are involved in a matter of urgency and it can be proven to the Court to halt a specific action, which will prejudice you if not stopped, then a Temporary Injunction is necessary while the matter is being heard by the Court.

WADE ROBSON’S LATE CLAIM AGAINST MICHAEL JACKSON’S ESTATE:

TMZ reports choreographer Wade Robson has filed legal documents, claiming the King of Pop molested him from ages 5 to 14. The now 30-year-old is asking for an unidentified amount of money from Jackson’s estate.

Here’s what TMZ had to say about the claim:

Wade’s lawyer filed legal docs May 1 asking the judge in the Michael Jackson Estate case to allow him to file a late creditor’s claim against the Estate. In the documents, Wade’s lawyer says he submitted a never-before filed complaint “for childhood sexual abuse.”

Wade’s lawyer has filed the actual complaint under seal — which means it’s not available to the public. Sources tell TMZ … the complaint specifically outlines the alleged abuse at the hands of Michael Jackson.

What Does This Mean?

Mr. Robson is asking for permission. He will need permission from the Court to file a claim on the basis of being a “late creditor” based upon a recent molestation allegation, however, it appears he has never previously filed a claim against Michael Jackson or his estate based upon these allegations. According to California Statute and the Los Angeles Superior Court, the representative of Michael’s estate has a duty to find out about all claims against the King of Pop and his estate and notify these claimants that the estate is in probate in order to properly administer the estate. Seeing as Mr. Robson is technically not a current creditor of Michael Jackson or his estate, has previously refuted claims that he was molested by the King of Pop and is in the process of selling his condo and moving to Hawaii after filing this claim, it all seems a bit fishy and opportunistic if you ask me.

How Does This Affect You?

If someone owes you money for goods or services and has passed away before paying the debt, you may be able to petition the court for payment from the estate, even if the claim is late……as long as the claim is valid.

OJ SIMPSON MOTIONS THE COURT FOR A NEW TRIAL:

Former Football Star Orenthal James Simpson is back in the news as he motions the Court in Las Vegas for a new trial stemming from a 2008 conviction of armed robbery, kidnapping and other charges. OJ was sentenced to 33 years in prison and now maintains that the items he “stole” were in fact his property and he received conflicting advice from a previous attorney. As he took the witness stand, OJ stated to the Court, “It was my stuff. I followed what I thought was the law.”

Simpson’s motion is hanging on the basis of showing his previous long-time friend and attorney, Yale Galanter, gave him bad trial and appellate advice and also had a conflict of interest in dealing with both Simpson and some of the memorabilia dealers. Additionally, he wants to refute witness accounts of guns being present during this confrontation.

What Does This Mean?

Statutes for a “Motion for a New Trial” are different in every state. In Nevada, where OJ is currently imprisoned, this motion may be brought where the defendant can provide new evidence as to why they are not guilty of a crime in which they were convicted. It appears OJ wants to bring new evidence to the Court’s attention to refute previous statements by witnesses for the prosecution, namely as to whether or not guns were present when he went to get what he believed to be his property back from the memorabilia dealers. He also wants to prove that the legal advice he received w biased as his attorney had a conflict of interest. If the judge grants the Motion and OJ gets a new trial, the previous verdict in his 2008 trial will no longer be valid and the case goes back to court. It’s like pressing a reset button on a trial.

How Does This Affect You?

If you or someone you know has been convicted of a crime, even if the case has gone to an appellate court and upheld, a Motion For A New Trial may be an available tool if new evidence can be presented to overturn the conviction. It must be noted that most Motions For A New Trial are rarely granted, however, it is worth a shot when new evidence is extremely beneficial to your case.

Additionally, “self-help” to get your stuff back is never a good idea when you have goons with you, who may or may not have guns on them……and your name is OJ Simpson.
