THIS SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA (EXCLUDING PUERTO RICO) AGED 18 YEARS OR OLDER AT THE TIME OF ENTRY (“ENTRANT”). THIS SWEEPSTAKES IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS AND IS VOID WHERE PROHIBITED BY LAW.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE ENTRANT’S CHANCE OF WINNING.
Eligibility to Participate: Entrant must be a legal resident of the 50 United States or the District of Columbia (excluding Puerto Rico) and 18 years of age or older at the time of entry to participate in this Sweepstakes. No entry fee, payment or proof of purchase is required to participate in this Sweepstakes.
Employees, officers, directors, affiliates, subsidiaries or agents of The Nielsen Company (US), LLC (“Sponsor”) including members of their immediate families (parent, child, sibling, or spouse of each of the foregoing) or their households, are not eligible to participate.
The Sweepstakes is subject to all applicable state, federal and local laws and regulations and is where prohibited by law.
Sweepstakes: The Sweepstakes will begin on Thursday, September 17, 2015 at 8:00AM ET and end on Thursday, November 12, 2015at noon ET. Entries received prior to the start date and time or after the expiration date and time of the Sweepstakes Period will not be considered.
Participation: Listeners from both the Tom Joyner Morning Show and the Yolanda Adams Show will be given a chance to participate in the sweepstakes. Participants enter the Sweepstakes by going to BlackAmericaWeb.com to register to win on the Nielsen branded page. All entries received will be entered into one (1) pool and one (1) winner will be randomly selected.
By participating, Entrants agree to these Official Rules, which are final and binding in all respects. Once submitted, an entry cannot be deleted, canceled, or modified. Entries that are incomplete or illegible are void and will not be accepted for entry. All entries become the property of Administrator and/or Sponsor and will not be acknowledged or returned. Automated methods of entry are prohibited and any use of automated devices will cause disqualification. Entrants may not enter multiple times or as multiple registrants. Any Entrant who attempts to enter multiple times will be disqualified and forfeits any and all prizes won, in Sponsor’s sole discretion. Entrant is providing their information to the Sponsor. Information submitted in connection with this Sweepstakes is governed by Sponsor’s Privacy Policy (available at http://www.nielsen.com/us/en/privacy-policy.html). If you are selected as a winner, your information will also be included in a publicly-available winners list.
Winner Selection: In each week of the Sweepstakes period, Nielsen will randomly select 1 person, 18 years of age or older who has successfully completed the entry page details on BlackAmericaWeb.com. One (1) $250 AMEX Gift Card will be awarded. Winners will be selected on Wednesday, September 23, 30; October 7, 14, 21, 28; and November 4, 11, and 18, 2015. A weekly winner will be randomly selected by the Sponsor from the pool of all correct entries through the date of selection. All winners will be notified via email. Winners will be notified on Thursday, September 24; October 1, 8, 15, 22, 29; and November 5, 12, and 19, 2015. Should any of the weekly winners not be validated, an alternate may be selected. Up to three (3) alternates may be selected. Winner is required to sign and return Affidavit of Eligibility, Liability/Publicity release (where legal) within five (5) days of date of notification. Sponsor’s decisions are final in all matter relating to this Sweepstakes. Odds of winning the prize depend on the total number of eligible entries received. Winners will be notified by email.
Potential winners are subject to verification, including verification of age. Sponsor’s inability to contact a potential winner within a reasonable time period or noncompliance with these Rules may result in disqualification and, at Sponsor’s discretion, an alternate may be chosen in a random drawing of all remaining eligible entries. Disqualification and subsequent selection of an alternate winner may result from: (i) the failure of a potential Winner to respond to notification within five (5) days after email transmission of notification of winning the Sweepstakes; (ii) the return of the email transmission as undeliverable after three (3) attempts, (iii) the return of any other communication or Prize as undeliverable, (iv) non-compliance with the Rules; and/or (v) failure of the potential winner to sign and return Affidavit of Eligibility, Liability/Publicity release (where legal) within five (5) days of date of notification. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor’s parent or legal guardian who must sign and return all required documents, if any. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.
Prizes: The weekly prize is one (1) $250 AMEX Gift Card
None of the manufacturers or companies listed above are participants or sponsors of this Sweepstakes.
Approximate Retail Value (“ARV”) is as of date of printing of these Official Rules. ARV of individual prize is $250 and of combined total ($250 x9 prizes) is $2,250. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded. Please allow 4-6 weeks for shipment of prize after notification and verification. Winner may waive his/her right to receive the prize. If waived or forfeited, the prize will be awarded to a substitute winner drawn in a random drawing from among all remaining eligible entries. Prizes are non-transferable, are not redeemable for cash and may not be substituted, except in Sponsor’s sole discretion. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Winner will be issued an IRS1099 form for prizes over $600 and shall be required to provide, to Sponsor, his/her Social Security number for tax reporting purposes. Winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether they, in whole or in part, are used. Entrants understand that models may only operate on certain carrier networks, which may or may not be compatible with Entrant’s existing network, if any. Requests for models compatible with a winner’s existing network cannot be accommodated. Winner acknowledges that Sponsor has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. Unclaimed prizes will not be awarded. A lost or stolen prize will not be replaced.
Unless otherwise prohibited by law, acceptance of prize constitutes permission to use each winner’s name, likeness, voice, city and state of residence for advertising and publicity purposes regarding the Sweepstakes in any and all media now known or hereinafter invented without territorial or time limitations, without additional compensation.
Limitation of Liability: Sponsor is not responsible for incorrect or inaccurate information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries.
Sponsor reserves the right, in its sole discretion to modify, cancel or suspend this Sweepstakes should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Sweepstakes. In the event of cancellation, Sponsor will randomly award the prizes from among all eligible, non-suspect entries received for the respective weekly period prior to cancellation. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter arise regarding the identity of the Entrant, the authorized account holder of said e-mail account at the time of entry will be considered the Entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion, to disqualify any Entrant (and all of his or her Eligible Transmissions) who tampers with the entry process.
As a condition of participating, Entrants agree (and agree to confirm in writing): (a) to release Sponsor, Facebook, Twitter, REACH Media, Inc., their affiliates, subsidiaries, retailers, advertising and promotional agencies and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, (b) that under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) that all causes of action arising out of or connected with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) that any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.

Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Sweepstakes Official Rules, or the rights and obligations of Member and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Illinois without regard to Illinois conflicts of law principles. Entrants consent to the jurisdiction and venue of the federal, state and local courts located in Chicago, Illinois.
