One North Carolina cop senselessly beat a man in a street last August, dash cam footage from an Asheville police investigation revealed this week.

Johnnie Jermaine Rush, 33, was punched in the head, restrained, held to the ground and shocked twice with a stun gun for only walking across a parking lot in Asheville on August 24, the Asheville Citizen Times reported. The man, who is Black, uttered the late Eric Garner‘s last words: “I can’t breathe.” However, no mercy was afforded to him by Officer Chris Hickman, who is White. Rush was suspected of jaywalking and trespassing.

The assault makes our blood boil, a sensation that people of color have known well with the dozens of police shootings and brutality cases in recent years. We are outraged.

Rush’s bruises stand as striking evidence against police brutality, and nothing has tempered his pain about the violent incident.

The case did lead to Hickman, who had actually been awarded a department medal of honor for actions taken in 2014, leaving the department sometime before Jan. 19, according to a memo obtained by the Citizen Times. An investigation was also launched into the attack last month.

The question still remains why Hickman thought excessive force was okay. Rush had been stopped for jaywalking at a street corner with light traffic that night. This particular street corner was known to be a place for dozens of pedestrians to cross without using the crosswalk, but yet, an example was made out of Rush, who had just finished a 13-hour work shift that night.

When an officer with Hickman confronted Rush, he threatened to issue a ticket or arrest him after a warning about jaywalking. The man, who felt harassed, was told to assume the position, but took off running in fear. The encounter with the two officers ended with Rush restrained and on the ground.

And the man was actually charged in the beating!

Thankfully, charges of assault on a government official; resisting, delaying and obstructing an officer, trespass and traffic offenses against Rush were dismissed by the Buncombe County District Attorney’s Office on Sept. 18. The investigation into Hickman’s actions is still ongoing.

The video in the case is not a matter of public record and can only be obtained by a court order, the Independent Weekly noted. However, many folks feel the footage should be released to the public. How would people be able to hold this officer and his department accountable and push for reform otherwise?

YOU KNOW THE OFFICERS ARE ALWAYS SAYING THEY WERE AFRAID FOR THEIR LIFE, WELL HOW DO YOU KNOW IF THE SO CALLED OFFENDER IS NOT ALSO AFRAID FOR THEIR LIFE. SO THEY TAKE OFF RUNNING. WE HAVE SEEN VIDEO OF THE OFFICER WHO SAID “HE GOT MY TASER. YEAH, THE ONE YOU SHOT HIM IN THE BACK WITH.” OR THE OFFICER WHO JUMPED ON THE OFFENDERS CAR ANS EMPTIED HIS GUN INTO THEM BUT STATES HE WAS AFRAID FOR HIS LIFE. THEN WHY JUMP ON THE CAR? HELL I WOULD HAVE BEEN TOO SCARED TO. “AND THEY HAD NO WEAPONS”. OR IN CHIGAGO THE BOY IS WALKING AWAY AND NO WHERE NEAR THE OFFICERS BUT THEY ARE AFRAID FOR THIER LIVES. ” HE HAD A GUN KNIFE THEY SAID..” NOT TRUE..ANOTHER LIFE GONE DUE TO SCARY ASS POLICE MEN. WHEN WILL THIS INJUSTICE STOP!!! YES IT IS A DANGEROUS JOB BUT YOU KNEW THAT WHEN YOU STARTED. DO YOUR JOB THE CORRECT WAY OR TAKE YAH SCARY ASS HOME AND SIT IN THE BASEMENT. DAMN….

Only Russian Bots, Coons, Sambos and Modern Day Slaves would defend this so-called Officer’s behavior. You can google Yahoo, HuffPost and various others sites where by in large the majority of respondents find the actions by law enforcement reprehensible. Oh the Mayor and Police Chief apologized, FBI questioned the victim, and those stupid trumped up charges were dropped. I know some folks love boot licking and staying on the plantation, but you’re free to disagree. They don’t have dominion over you, they are no longer your masters. Once again, slaves keep responding to me. It hurts to see someone who is well thought out and don’t believe everything that comes out of someone’s pie hole. When it doesn’t make sense, it doesn’t make sense. This antagonizing of that citizen didn’t make sense. I hope the citizens of Ashboro pay for it. More importantly, I don’t care that the Officer resigned, I hope he is charged for abuse of power and battery. Only on a black website will modern day slaves keep defending the actions of their masters. Come on slaves do your usual. Don’t read, just see black and put the rope on the tree to hang your fellow man. You coons are the worst.

He resisted arrest and ran- that is what precipated his violent apprehension. Jaywalking was probable cause- not the reason he caught a beatdown. This guy is not a victim.

Ridiculous and outrageous behavior by that so called officer. First off – be professional at all times. When speaking with the civilian don’t lower yourself like you’re his buddy by calling him man. You lost his respect. He is a Sir or call him by his name. You are in the position of authority and if you elect to stop someone for jaywalking, handle your business professionally. The so called former officer was an embarrassment to the department. That is why he left. They could have started writing the ticket immediately. Then it went to assume the position- all for the earth shattering offense of supposedly jaywalking. Crush that man’s face in the ground, and knees in his back for supposedly jaywalking. Outrageous. If it wasn’t misconduct the so called Officer would not have resigned or left the department. He’s not fighting or punching them. It’s disgusting. The so called Officers also have discretion. Just like they don’t stop everyone for speeding, they could have let him go on his merry way home. Nope. “he is trying to punk me.” You’re either a professional or you’re not. In that line of business- you have thick skin. Most people recognize abuse when they see it. I’ll wait for the normal riff raft SAMBOs to defend all things white and hate all things black. In 1-2-3…where are my Russian bots, and boot licking wanna be slaves?

Ted, just when I think you’ve freed yourself from the liberal plantation, you go and climb the fence to get back in. Any comment on the thugs behavior, running away, mouthing off, resisting arrest, disobeying a lawful order? Come on bro-bro

    • “Unfortunately, Ted couldn’t survive outside the plantation. His dependency on group think and prepared talking points was too ingrained. He climbed back over the fence last night, and last reported, guzzling the Kool-Aid like a drunken sailor on shore leave. Let’s hope he regains the courage to leave and think for himself in the future.”

      You off the hook Mac

  5. Why not just take the ticket and see them in court? I was stopped twice last year, issued tickets, and went to court and got them dismissed. I didn’t argue with the officer. I didn’t curse at him. I took the ticket, wished them a nice day went on my way. Yeah, I was annoyed. I didn’t agree with the reasons for the tickets. But I saw no benefit in arguing, cursing and being belligerent. I went home. He/she went home. My tickets were dismissed. No foot chase or tasering involved.

To my black people, when stopped by law enforcers, you don’t give them a reason to beat you half to death,or even kill you for a minor offence. It was obvious that these were race soldiers looking to arrest or beat a negro for something as minor as jaywalking. The FBI has said law enforcement has been inflitraded by white extremist groups,so when detained by these law enforcers you have no way of knowing if they hate black people, with that being said. You want to make this encounter with these people as short as possible you don’t say shit let them ask questions and you answer, because you want to get home alive.Black America, weather you no it are not you’re in a race war.
