DeKalb County Georgia police officer Demetrius A. Kendrick was indicted Thursday on the charge of violation of oath by public officer for falsely planting drugs on a man and arresting him in 2012, reports

Kendrick’s bond was set at $10,000 bond and he was given 24 hours to turn himself in.


Prosecutors say Kendrick, a five-year DeKalb cop, wrongfully arrested Alphonso Eleby on July 6, 2012 and charged him with marijuana possession even though the officer knew Eleby didn’t have drugs on him.

Eleby and his attorney claim that Kendrick was caught on film planting drugs on Eleby.

On July 6, 2012, Eleby stopped to talk to someone inside a black SUV parked at the Chevron gas station on North Hairston Road.

Video of the incident obtained by Channel 2 Action News shows a female officer stand over Eleby and watched him while other officers search the SUV.

The video shows a male officer Bullman identified as Kendrick call the female officer over to the SUV. While she searches the vehicle, the video shows the male officer circle back to Eleby and toss marijuana next to him.

Charges against Eleby were dropped after the police department could not produce the marijuana Kendrick planted near Eleby.

“I’m glad that camera was there to prove my innocence and justice was served,” Eleby said. “It was a blessing from God.”

Kendrick faces up to 5 years in prison if convicted.
