Lawyers for the estate of Nina Simone are reportedly suing smartphone and tablet manufacturer HTC for using one of her songs in a commercial without permission.

According to TMZ, the lawsuit accuses HTC of using Simone’s 1965 single “Sinnerman” without obtaining the rights. The ad uses a Felix da House Cat mix of the song. [Listen below.]

The singer’s heirs are demanding $1 million in damages, TMZ reports.

Simone died at her home in France in 2003 after battling breast cancer for four years.
