Jimmy L. Davis Jr. alleges he was kicked out of Houston Motel 8 room because they complained about mold in their bathtub.

The Georgia native is suing the company for $5 million citing discrimination over the 2011 incident.

According to the Houston Chronicle:

Davis and a friend were in Houston on Aug. 27, 2011, on a real estate and church event trip when they stopped at the Motel 6 at 2900 W. Sam Houston Parkway to rent a room for the evening, according to court documents.

Davis, who is African-American, said that Motel 6 and its employees discriminated against him because of his race after he complained of black mold in the motel room shower.

Motel 6 employee Ed Gardner, Davis alleges in the lawsuit, became angry with him for complaining about the mold and roared at him that, “It’s not black spots in the tub, the only thing black is you all, you black morons, get the hell out of my motel before I throw you out and call the Houston Police Department on you and have you both arrested!”

The lawsuit claims Gardner then called security to Davis’ room to escort Davis and his guest off the premises.

Security entered the room and saw that there was black mold in the shower and stated that Gardner had been incorrect in his actions, documents state.

Davis and his friend were still escorted off the property and were forced to find alternative rooming accommodations elsewhere, the lawsuit states.

Davis has named 12 Motel 8 employees in his suit.
